Legal Question in Family Law in New Jersey

I was married for 9 years and was divorced in 2012. My ex-father-in-law co-signed on student loans for me prior to my separation and subsequent divorce. My ex-father-in-law took money from his 401k to pay off the loan ( I never asked him to pay it off with his money) and asked that I pay him monthly, which I have been doing so until I became unemployed this past December 31, 2015. I was then evicted from my apartment and almost lost my car and informed him I would pay him back when I was back on my feet. Now he wants to sue me, is this possible?
