i been married for 6 yrs, my wife left since 02 a few month s after the marriage to her native country. i live in nj and she is out the country how can get a divorce. the marriage took place in miami fl but now i live in nj

You can file for divorce in New Jersey if you meet the residency requirements. If you do not know where she resides, you may request that the court allow you to serve by publication.

As my LAw Guru colleague mentions, you must live here for one year in NJ to get a divorce here. (I thinkl there may an exception for an adultery cause of action but if she never lived here in NJ that would not be helpful. Your spouse may wish to acknowledge service of the divorce papaers (Summons & Complaint) in writing in the presence of a Notary or have her served by the legal proces server in that country. Servie by certified is good if you can get her to Answer or acknowledge service. Publication is also a resort as my Guru colleague has mentioned--that is ususally invoked when no address is known---you can then publish the papers in the newspaper. Maybe she will cooperate if you can find her in case she may wish to re-marry or the like. Good luck--my Guru colleague seems closer to your zipcode.
