Legal Question in Family Law in New Jersey

do i have a right?

my ex and i are going to mediation. he is remarried. unforunately, he cannot think for himself, she does all the thinking for him. everytime we sit down to discuss things regarding our daughter, he looks to her to make sure he is saying the right thing. i feel that if she is in the room with us during mediation, he will do the same thing. do i have a right to request that his spouse not be in the room during mediation?

Re: do i have a right?

While I am not sure if this is court order or voluntary, most mediators will honor your request to keep his current spouse out of the room unless there is an issue that would involve her.

You condition that you will use mediation only if his wife is not present because the issues you

attempting to resolve concern your children and not her children.

Call me if you like.

Re: do i have a right?

Yeah, you could set any condition you want because mediation is voluntary. You may even want to get a new mediator. I have one that I use that I can refer you to.

If you have any other questions, feel free to give me a call at 732/247/3340. My initial consultations are always free.
