Legal Question in Family Law in New Jersey

Medical co-pays

As it states in my original div. agreement i provide med. coverage for my children, after 7 yrs. my x now wants me to pay half the co-pays . The orig. div. agreement does not

state that i am responsable for co-pays just med. coverage . I have had my current med. cov. since 2004 and my x has NEVER submitted a claim, she uses her current husbans ins. and never combinds the two, which could possibly reduce the co-pay to 0. I do not belive that co-pays should be my responsability as well as child support, med.coverage, life ins. and everything else.

thank you.

Re: Medical co-pays

If you children are covered by another medical insurance coverage your former spouse is required to submit their medical bills to your insurance carrier first and then to the insurance company proving the other medical insurance coverage, which should reduce the balance to zero.

As for the copay, it seems reasonable that your former spouse pay it up to a point but there are limits because the copay might exceed what you are paying for the insurance coverage.

Call me if you would like to discuss the matter.
