Medical costs

myhusband and i have been separated a little over 18 mos. - filing no fault. However, in the meantime my daugther needs $1500 worth of orthodontic work - $500 of which I hae already paid out of pocket. In addition, we are now starting to put together benefits for 2008. Doe she have to BY law- pay 50% of my children's medical? also, is he obligated in any way to pay anything additional (we were married in 2004)? thank you

No attorney can give you a definite answer to these questions. There are a lot of factors that are important, including your income, his income, your lifestyles, what you have/have not agreed on.

Major issues: child custody, support, alimony, division of assets and debts, pension plans, and more.

Let me summarize:

you are in the middle of a divorce.

You may have a job. You may have a house. you may have savings, pension, credit card bills, and other things to deal with. Your spouse may have a job.

you have a child (children), and child support and college tuition needs to be paid. That is measured in tens of thousand of dollars.

Nothing that an attorney can say over this bulletin board can come close to helping you solve your problems. Careless actions by you will likely cost you thousands of dollars, make your life more difficult, and possibly cause additional harm to the child.

Hire an attorney. Go see an experienced divorce attorney located reasonably near you, and pay the attorney to review your situation carefully with you, and give you some guidance.

Both parents are responsible for the bills related to their children receiving needed medical and dental attention. The individual responsibility for a child's dental and medical expenses are ususlly split based on income.
