Legal Question in Family Law in New Jersey

Medical Insurance After Divorce

I am permanently disabled though I have sole custody of my 2 children. My wife and I have been separated for 6 years. The court ordered that she carry medical insurance for the children and me. If we divorce, is there a law in NJ that requires her to continue to carry medical insurance for me for 3 years AFTER the divorce becomes final?

No. You are probably thinking of your right under COBRA laws to continue your coverage under her policy for 3 years.

Of course, your financial needs including health insurance go to the issue of whether alimony should be paid to you.

See a lawyer for a more complete review of your rights.
