Legal Question in Family Law in New Jersey
mens rights w/wedlock child
my 24yr son accepted responsibility for his daughter born out of wedlock and is up to date with child support ordered by the courts, the mother of the child is quite formatable personality, quarells and fights quickly. she recently filed complants against him, and now we need to deal with the criminal courts and he cannot father the child as original agreement.
dealing with the mother has become impossible, can he now give up all rights to the baby and pay a small monthly child support payment. so he can get on with school and lead a productive life.

Re: mens rights w/wedlock child
Let me ask you a question - As a mother: Would you have thought it appropriate for the father of your child to "give up all rights"? I really am quite astonished that this is an issue. No matter how hard it is, it is not only the duty of your son to do what is right for his child, it is his legal obligation. He should be paying child support, at least in accordance with the child support guidelines, and giving all appropriate emotional support to his child. Both parties have the obligation to raise the child, physically, emotionally and financially. Both your son and the mother of the child are going to need to find a way to compromise on all issues. They are stuck with each other for at least the next 18-25 years. I might suggest mediation for both of them. There are plenty of good mediators out there who could assist them in this case. In fact, I have been trained as a family mediator and would be happy to assist them. However, one of them needs to call me at 856-546-8010. If they mention LawGuru, there will be no charge for their first consultation. If they decide not to utilize a mediator, your son should consult with an attorney as soon as possible. Good luck!
