Legal Question in Family Law in New Jersey
mental abuse
My daughter is planning to divorce from her husband, due to over a decade long mental abuse.
He now is beginning to mentally abuse their 3 and 9 year old daughters, hoping to put blame on their mother and deflect it from himself.
Is telling a 3 year old daughter: ''Your Mommy doesn't love me anymore'', considered mental abuse on a minor?? If so, is it a State or a Federal offense??

please tell her that she should call an experienced divorce attorney immediately and get some advice.
Re: mental abuse
I don't see any criminal charges here. However, she does need a good divorce attorney to handle this.
My initial consultations are always free, so have her call me at 732/247/3340 and we can discuss her situation.
Re: mental abuse
The conduct is probably not a state or federal offense but it may raise a question as to fitness as a parent and result in Court action.
Your daughter should consult counsel to determine her rights and the best course of action.
Re: mental abuse
Talking to children about a failed marriage is not considered 'abuse' by any state or federal statute. In the course of a divorce, there is generally a requirement by the courts that parents do not make any disparaging remarks about the other or alienate affection.
Both parties would benefit from a divorce oriented parenting class.
Re: mental abuse
It is abuse but whether it is criminal is a matter of degree. A civil court which believe he engaged in such conduct might bar him from visiting with the child.
Call me if you like.
