Legal Question in Family Law in New Jersey

minor's decision to move

my son lives with his mom in nj. i live in fl. he wants to live with my mom in nj as his family is moving to maryland and my son is not in a happy situation at home. is he allowed to make this decision or do we have to go to court and ask. also what is involved in the court. is it just documents or is there an actual hearing with testimony etc.

Re: minor's decision to move

If the mother is agreeable he can move to Florida. If she is not you must apply to the Court for an order approving the change of custody. Even if she agrees it would be a good idea to get her to sign a consent order changing custody so that she can not simply change her mind a week after the child moves.
