missing court records

how long should court records be

available? As in, my divorce was nov.

2005, emergency motion filed 5/06,

several postponements by defendant,

case moved to another county.

shouldn't there be records of this?

transcripts? I was told for the

divorce hearing that while it shows

on the clerks computer when she

called the outsource company they

said it's been deleted?! I was trying

to get the transcripts from my

divorce hearing and the trail of

paperwork from the emergency

hearing. both counties have nothing

of the emergency hearing. Nothing.

You may need to consult with your attorney for these papers and pay any necessary retrieval fee. I would also consider requesting the documents in writing to the Presiding Judge of the Family Part in the Vicinage where your proceedings took place and also ask the Family Case Manager's Office by copy of the same letter. Usually there are archives for such documents. However, if the court did not treat the matter matter as an emergent matter the papers may not have been file and perhaps nothing was placed on the record. As far as the divorce hearing that should still be available I have gotten transcripts several years back. Try requesting these in writing or pay a lawyer to get them for you. Good Luck!
