Modification of Parenting Time
I posted questions earlier in regards to my stepson's mother now after 3 years requesting 50/50 because as she stated, her weekend time with her 15 year old is getting less becuase he has friends. In the 3 years since we have had custody, my stepson has been in honors, is excelling in everything and doesn't want to live half of his time with his mom. There was too much mental abuse from his stepfather. Will a judge in his right mind change a custoday arrangement becusee the child is growing up and is a typical teenager? Will the judge go against his wishes? The best interests of my stepson is the current arrangements. Emotionally and academically. What is your opinions in this matter. Thanks!

You have it right, the judge will consider what is best for the child, not the mother. Children get older and they spend less time with their parents - a harsh realty which is made even more harsh when you split time with the child due to a divorce. Judges consider each case on an individual basis. It is important to tell the whole story to the Court - - in an appropriate fashion focusing on what is best for the child - - not the parent.

I think I said this before, he's 15 and the Judge is not going to disturb his wishes absent some amazing evidence.

The judge must education about the young man's situation. That is the function of the lawyer you hire. If your position is properly presented to
the judge the judge will probably do the reasonable thing.
