Legal Question in Family Law in New Jersey
Modifying Visitations
My son's father moved out of state to be with his new gf. We have an order of visitation already. Now because he moved he wants to me to let my 6 yr. old son go to Ohio where he is for the holidays & Summer vacation. Can he do this? I don't know anything about where he is living or who would be taking care of son if he is at work. What can I do, if anything?
P.S.
When he lived in NJ he didn't get my son when he was supposed in the first place, he doesn't even call him. Now he wants to have visitations. Can I somehow counter what he is trying to do?

Re: Modifying Visitations
Normally, out of state visitation is one month in the summer and one or two other holidays or spring break. The holidays are normally changed from year to year.
Knowing where your son lives and with whom is a necessary condition of out of state visitation. Additionally, his prior history of not taking full advantagae can be cited in requesting that, initially, visitation be less than the plan I have outlined above.
