Legal Question in Family Law in New Jersey

Money that is owed

This is my situation: Through my divorce settlement my ex husband is suppose to pay 75% of health benefits. I have the benefits thru my work which comes out of my pay. My ex has never given any kind of supplement. I took him back to court and the judge ordered him to pay up.. Still to this day he hasn't given me anything for this. It is well over $1,000.00 now. My question to you is can I not pay the mortgage for as many months that he owes for insurance (kind of a wash)? The mortgage is in his name only but I am responsible for paying it. Or is there another way to go about this?

Thankk You for your time

Re: Money that is owed

It would be kind of self defeating if you didn't pay the mortgage and (assuming you are living in the house) they began a mortgage foreclosure. If he has been ordered to pay and has not, you should ask the Judge (unfortunately you'll need to file another motion) to put him in jail if he does not pay you. If you have any more specific questions, you should speak with an attorney. If you want to speak with me, feel free to call me at 856-546-8010; mention Law Guru for a free consultation. Good luck!
