Legal Question in Family Law in New Jersey
I am the mother of two children. I have been split up with their father due too domestic violence for a year. I have a permanent restraining order in place. At the restraining order hearing I got granted custody Monday through Friday he recieved parenting time on the weekends. I recieve $50a week for child support every sunday when my children are dropped off after their weekend visits. I am in the process of obtaining child support i am wondering if their is any way that the father can try to gain full custody of my children due to any circumstances. Also my kids grandparents (his parents) are very spiteful they try to get me to drop the restraining order and i fear that they have alterior motives, such as them selves gaining custody of my children. Is that possible. I have my own apartment which the kids live with me during the week, please give me some information about child support and custody. I am a little worried about the whole situation. Thank you.

Of course the father can try to gain full custody. And depending on the circumstances, it may occur. Likewise for the grandparents. Is it likely? I would think not. It is impossible to answer your question with any more specificity without a long and comprehensive discussion with an attorney.
Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other facts that would change my opinion. And, no one can rely on the opinion of an attorney who has not been retained. Before you do anything, you should consult with a Family Law attorney. Good luck! Rob Gleaner
