Mother's day
What can I do when I no longer have residential custody of our 9 year old daughter and it;s Mother's Day? She lives with her father about an hour or so away and of cousre he will not bring her to see me on this day(jerk). He may answer the phone after 3pm and extend the offer of me coming up to the house, but I would really like her to be here to visit her grand and great grandmother's...that would really be nice, they love her, we all do...of course! It's not so much of a selfish issue, but my concern is for her answering all of those awkward questions when everyone asks the famous question of how she spent Mother's Day with mommy...please help! This holiday is becoming a recurring nightmare!

Do you have a Court Order for parenting time with her? Is it unsupervised? Does the Order provide for holidays? Does it specify who is responsible for travel? These questions cannot be answered by an attorney without seeing the paperwork and getting a factual history. Unless you see an attorney in person or file your own Motion, you won't get this problem solved.

You need to file a motion and ask the Court to Order the parties to follow the Court's holiday schedule. This schedule provides guidelines for the holidays, and you would have had Mother's Day even if it was his scheduled day for parenting time.

I have to assume you never had an attorney for the visitation issue because if you did, you would have had all of these holidays worked out. Might be time to call one so you can stop going through this at every holiday. Call me at 732/247/3340 to discuss.
