Legal Question in Family Law in New Jersey
Ex is trying to move my kids out of state
Hello, I actually have 2 questions. First what is the actual definition of child abandonment? Second I already went to court with my ex about custody of our children (which we have joint) in the court papers it says that neither of us can take the kids out of the state. He is threatening to move the kids to another state, if he does this behind my back, what can I do? He took them to another state last year for a week and I called the police and they wouldnt help me! Now he is trying to move them there for good so I cant see them anymore!

It sounds like you have a lot of issues and that you went to court by yourself. I can tell because it doesn't seem that you are getting anywhere on your own. You should really consult with an attorney ASAP. You could file a motion before he leaves the state or wait until he leaves.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.

He can leave the state with the children for a brief visit, but he must return them to the state until a judge authorizes taking them out of the state and judge may not give such authority.
Call me if you like.

I have read what the other attorneys have said.
You really need to get some assistance from an attorney. I suggest you find an experienced divorce attorney (this is a divorce type problem) who is not too far from you, and ask the attorney for assistance. You will have to pay the attorney for the attorney's efforts.
There is a lot at stake. Get a lawyer!
