Possible move that violates state custody laws

I'm the custodial parent of two kids. We moved from New Jersey to PA in June. I consulted with an attorney before moving who stated I only had to notify my ex 30-60 days before I moved and that the burden would be on him to prevent me moving. I've since discovered that I was supposed to petition the court for permission to move. How do I fix this now that I have moved? The ex is still considered to have joint custody even though he hasn't seen them in 2+ years. I want to file for sole custody in PA but don't want any problems from Jersey.

Well, you do have a bit of a problem. What county did the custody Order come from? You may have to go back there.... however, you have been in PA for about 6 months, and that would be considered residency for filing for a change in custody...

Do you have an address for the ex?? Does he pay his support? Please write back. I practice in both PA and NJ.

You should file a motion with the court in New Jersey, explaining the advice you were given and requesting the court to approve your move. You should also call me to discuss your case.
