Legal Question in Family Law in New Jersey

We moved in

My husband owns a home with his ex-girlfriend who lives in another state; over three years he has tried to sell but she wouldn't sign, the house was in foreclosure but my husband had a chance to save and refinanced...now we and our son decided to move back end to save the home...we pay all the bills and she will get half once we sell...now she doesn't live in the state and doesn't pay anything on the home can we legally live there and has she abandoned the property. Also, we spent thousands on lawyers with no result.

The obvious solution is to buy her out. If she will not sell her interest voluntarily, you can bring a lawsuit to force the buyout, or to have the property sold. The key is to aaproach her the right way so that she understands being unreasonable will result in her getting less money as the market declines and she incurs legal fees. Based only on what you have said, your husband maybe needs to file a 'partition' action, to have the house sold. The market is lousy now, so you may not want to do this. You have some other options, but doing nothing will likely cause her to get more than doing something now.

You are likely to be more successful with an agressive and smart attorney representing you.
