Legal Question in Family Law in New Jersey
Moving
My family is looking to relocate to NC from NJ because of a job opportunity and expense of living. I am divorced with 2 boys ages 11 and 12 and I know my ex will fight the move. We currently have joint custody but I am the custodial parent (he sees kids on weekends). How do I handle this if he refuses to agree to a custody agreement with me. I dont have a lot of money to fight in court. Can I be denied the right to relocate? Should I go to court before we even make the plans to move (sell our house etc.)

Re: Moving
You have to file a motion with the court before you will be permitted to move. These cases are not liberally granted and you have the burden of proof. A good attorney will cost you some money and if you don't have it, you face a real uphill battle. You may be better off waiting until you can afford a good attorney.
Re: Moving
You seen to have a good idea of what you have to do to move and to understand that you should learn whether you can move with the children before you sell your house.
You seem to have good reasons for moving and have a good chance of obtaining court approval for your moving.
