Legal Question in Family Law in New Jersey

moving out of house

I asked my husband for a divorce which he doesn't agree to. I want to move out of the house and take my 7 & 8 year old daughters with me. Can I take them with me without any complications or violations of the law? Can my husband stop me from leaving and taking the children with me?

Re: moving out of house

Your husband can object to your taking the children with you, but will he? If you take the children when he is not at home the taking should be uneventful. Assuming that currently there is no court order controlling custody of the children you will not be violating the law if you take the children with you.

I feel that there is more for you to consider. You might confer with a local divorce attorney before leave with the children. Based on your zip code I gather that you are living far from Hackensack and would not want to confer with a Hackensack attorney.
