Moving out of state
I have been divorced for 5 years, and remarried for 2. I have a 6 & 7yr old. I am looking to move out of state for financial reasons and better life for my family. My divorce took place in NY and my ex agreed for me to move to NJ, but I know he will not agree to anywhere else. My husband and I are really struggling in NJ. What is the best 1st step to take to ensure we will get the outcome we need? Should we have jobs lined up already or wait for the court's decision? I am confused and want to ensure I do everything I can to go about this matter in the right way. Please advise me. I know I will need a lawyer, but I just want some basics to start.

You really need to sit down with an attorney to get a plan together. Find an experienced divorce attorney located not too far from you.

Re: Moving out of state
You should consider docketing the New York judgment in New Jersey because you and you child or children reside in New Jersey. Once the judgment is docketed in New Jersey you can file a motion for an Order permitting the move out of state.
