moving out of state w joint custody

I live in new jersey and have joint custody of my 2.5yr old. His father sees him for overnight visits every other weekend from friday night until sunday evening. I want to move to North carolina because i will be able to purchase property in which my son can have his own room and space to grow in. I also have better job opportunities in field of massage therapy there. What r NJ laws regarding this matter?

You will need written permission from his father OR you will need permission from the Court.

If the father will not consent to your moving with your child, a judge probably will, if you demonstrate economic necessity and that the purpose is not really to deny visitation by the father.

You must get court permission to relocate out of state. Your reasons must be clearly stated and should be backed up with appropriate facts and documentation. Properly presented, these types of applications have a very good chance of approval, so it is important you have an attorney represent you. Contact me if you are in my area.
