If the father will not consent to your moving with your child, a judge probably will, if you demonstrate economic necessity and that the purpose is not really to deny visitation by the father.

You must get court permission to relocate out of state. Your reasons must be clearly stated and should be backed up with appropriate facts and documentation. Properly presented, these types of applications have a very good chance of approval, so it is important you have an attorney represent you. Contact me if you are in my area.
