Legal Question in Family Law in New Jersey

mutual lawyer?

I am in the middle of a property settlement and divorce. My spouse has hired an attorney I consulted 2 years and 4 months ago. I had an in-depth consultation with her, disclosing a great deal about the reason for divorce. She has now stated that she does not remember me and is representing my spouse on the first stage, on a property settlement agreement. How is it not conflict of interest????? I divulged a LOT of information to her! Please let me know. Thanks.

Re: mutual lawyer?

It would absolutely be a conflict and you have a right to object. If you are represented, you should bring this to the attention of your attorney. If you are not represented, you should seek counsel immediately. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner

Re: mutual lawyer?

It does not matter that she does not remember you; there is the appearance of conflict and she can not represent your husband.
