Legal Question in Family Law in New Jersey
Nephew in prison for next 6 years. Wife and he decided to divorce. they have one son. What rights, if any, does he have? Can she take everything that was in their apartment when he got incarcerated--even stuff that was HIS property? Can she get full custody of their son because he can't go to court to fight her? Will he be able to get visitation with his son? Is she obligated to bring the son to the prison for visits? Can someone else take their son to the prison for a visit? (The prison says we can but what will his soon-to-be ex-wife say?) Would he be obligated for support of the child while he is in prison?
