Legal Question in Family Law in New Jersey

NJ custody enforcement

My husband has a custody order with his child's mother that states for summer vacation time you are to give 30 days notice with itinerary and contact information. We have done this for the weeks we get his child. This morning we get an e-mail stating she is to have vacation time in 10 days from today (which also happens to be the next scheduled weekend we get with the child). Their was no itinerary, no contact number, and of course no 30 day notice for this vacation. What should we do? We have no money for attorneys as she is ALWAYS making up her own interpretations of the custody order and we are ALWAYS in court for something... ie- doesn't answer phone calls when times she has to, doesn't inform us on dr apts, didn't put fathers info on school paperwork, the list goes on and on. But, unfortunately this in the eyes of the court is all ''petty'' and it never reaches a judge. They always go to mediation or face to face talks with attorneys in the room to hash out another modification to the order in which the father gets a little more. But, she is ALWAYS getting past not getting in trouble. And adding more for the father is great if she would follow through with it. How can we stop her from ignoring the order??

Re: NJ custody enforcement

This is going to take some careful work. The Judges hate trying to figure out whether there is a real problem, and who is at fault in situations like this.

You are much more likely to succeed with an attorney's assistance.

My answer to most of these questions is a good attorney. Might not be a total cure, but with no attorney or a bad attorney, you will be facing an uphill battle. Call me at 732/247/3340 to discuss.
