Legal Question in Family Law in New Jersey
nj custody law
My Ex-husband is in the middle of his 2 week visitation time with our children. He however states that I am only legally allowed to call the children every other day. I bought my 8 year old daughter a cell phone where she can only call and receive calls from me. My ex-husband has taken it away from her and only puts it on for a limited time and shuts it off after I speak with the children. He also has a cell phone and does not always answer my calls. He is breaking our custody agreement which states that we cannot interfere with each others contact with the children. Is he right with the every other day law or am I right with the custody agreement? Please help me I want to be able to speak with my children when I want.

Re: nj custody law
I think common sense has to prevail here. There is no such thing as an ever other day law. You are governed by the terms of your settlement agreement, but that has to be interpreted with the best interests of your children. If you are call too much that could be an issue. However, you have a right to communicate with your children. If your children are safe and not complaining why make an issue out of it.

There is no every other day law. You may want to actually speak to an attorney. Regardless, you should try to resolve this with him or take him back to court and get this issue settled.
