Legal Question in Family Law in New Jersey

My NJ divorce agreement says I am obligated to half of my childs college expenses and would still need to pay child support until she graduates college.

My 2 part question is;

1) If she wants to go away to school can I ask for the support to stop since I would have to pay for room and board at college?

2) If I can not financially afford a school she picks am I obligated to go into debt I can never get out of just because of an agreement that was made 15 yrs ago?

The basic obligation is the Rutgers standard for college expenses, unless a parent has very high income. You can ask to restrict child support to only that part of the year that the child lives at hiome, prorated over 52 weeks. A significant change of circumstances justifies a chnage in the support obligation. In you case, the change is the difference in the cost of college fifteen years ago and now..

You can file an application with the court to modify your child support obligation but not to end it. As far as college expenses are concerned you should review your psa with an attorney. call my office to set upan appointment.
