In NJ, with joint custody can ''mom'' move, or can she be ''made to stay'' in NJ?
I am in a situation where I have been verbally informed by my daugthers mother (never married but we have joint custody) she wants to move to Florida in two years. I recently found out from my 10 year old daughter, my ex has been shopping for houses in florida. What can I do so my wife (of four years) and I don't need to move to Florida....Can we petition her to stay?

You can ask the Court to deny her permission to permanently move to Florida with your child.

you do not need to move to FL. you cannot force her to stay here. do you have a formal custody agreement? if so, she must petition the court to leave the jurisdiction. if she moves without petitioning the court, she could be in trouble if she takes the kids...Interstate Kidnapping statutes kick in if she moves the children without court authorization(federal offense). You can do a few things to help yourself prior to her filing such a petition if she indeed plans on moving. Call my office to discuss...free consultation.
