NJ Law prohibits sex offenders from custody

I have recently gone to court pro se

for sole custody of my children. My

ex is a convicted sex offender, being

convicted of endangering the welfare

of a child, and a megans law

registrant.

Before i could even present all of my

facts, i was interupted by the judge

telling me, he was not giving me sole

custody, because he was not going

to deny my ex's rights to his

children. So a judgement of joint

custody was entered, with myself

having residential custody. He was

also awarded Phone visitation and

supervised visits through the ocean

county court program.

Upon researching a way to appeal

this decision i came across a NJ law

that perhaps could benefit me.

9:2-4.1 Person convicted of sexual

assault, custody of, visitation to

minor child; denied, exceptions.

If there are any attorneys here who

could confirm that this is a NJ law

that is in effect and could help me in

appealing my case, please respond.

The law you cite requires that the sex offender make a clear and convincing showing that he will not

present any danger to the child and if

custody/visitation is granted the order granting same is supposed to be

stayed by the judge for ten days so that an appeal can be taken.
