If the non custodial parent moves out of the USA.

If the non custodial parent moves out of the United States is it possible to ask for and recieve sole custody of the children. He plans never to return.

Yes, you can ask for sole custody; the Judge will then decide what is in the best interests of the children.

Is there any concern that he may try to get the children out of the country?

I really doubt it. The other parent would have to be so bad, that DYFS would have been involved already anyway.
