Non- custodial parent will not give medication

In NJ what can be done to a non-custodial parent that will not give doctor prescribed medication to a child during his weekend visitation. This has been going on since June 2002 and now it is March 2003. It has happened every weekend not just once or twice during this time span.

Like anything else, if one parent is not doing what needs to be done, a Court Order is needed. An Affidavit from the child's physician concerning the necessity for the medicine should be sufficient in connection with the filing of the Motion. Depending on the opposition, testimony may be necessary. You must keep in mind, however, that this advice is based purely on the little bit of information that you have given to me. There certainly could be factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained.
