Can non-citizen spouse take children out of country, against father's will?
My friend's wife, who is not a citizen, has threatened to take their children back to her country of origin for good. Is that considered kidnapping? She is using this threat to force him to remain married to her. Can she use his e-mail correspondence to me against him? What are his rights and what should he do? Also, she drinks and has been physical with him in the past.

She can not lawfully deprive your friend of the custody of or visitation with his children. An order can be obtain restraining such an action.
