Legal Question in Family Law in New Jersey
Non-custodial parent acquiring physical custody.
I have a 7 year stepson whose mother is a spiteful, revengeful woman. She and my fiance have been back and forth to family court since my stepson was a year old. A court order was imposed two years ago granting my fiance physical custody during the weekdays of summer. And during the school year,my fiance would get his son every other weekend and take him to school on Mondays. The mother was also supposed give my fiance his child's schoolwork and any academic notifications. Since the judge has ruled this order, the mother has not cooperated. She does not want the child's father in his life. She constantly gives him a hard time during the summers and recently refused to give him his son's school uniform and school work. My stepson has already repeated a second year in kindergarden and I am concerned that he may still be in kindergarden a third time! My fiance wants his son to stay with us because where we live has a great school district. He has already filed papers to take her back to court. What are his chances of obtaining permanent physical custody?

I see this a lot, questions asking about %'s. There is just no way any of us can give you any real figure without knowing your case. Also, our opinion doesn't matter too much because we don't wear black robes.
If this case is really important to you, the best thing you can probably do for yourself is hire an attorney.
