Legal Question in Family Law in New Jersey

Non-marriage custody & child support

My husband has a child from a previous relationship, but there was no marriage involved. What does that mean in terms of her ability to get child support? I was also informed that my income will not have anything to do with the child support is that accurate? The mother of this child works under the table so she shows no income, how would we get accurate records of her income for the child support amount to be determined? What am I entitled to as his wife when we have children of our own in the state of New Jersey ?

Re: Non-marriage custody & child support

Her ability to get child support is based on her position as a mother and your husband's position as a father, and not their previous relationship (marital or not.) His income and her income would be taken into consideration and put into the NJ Child Support Guidelines. Your income would not be taken into consideration, although the fact that there are children from a second relationship is factored into the guidelines. In order to determine your husband's rights and obligations, he should immediately consult with an attorney. If he wants me to assist him, he needs to call me at 856-546-8010. If he mentions LawGuru, his first consultation is free. Good luck! Rob Gleaner
