Legal Question in Family Law in New Jersey

Non-resident divorce proceedings?

I was married by a judge in Missouri in May 2006. Both of us resided in New York prior to and through July of 2006. In August we moved to New Jersey. Where can I commence the process for divorce? It seems all states require 12 months residency. Does this mean i am prohibiting from divorcing until next august?

Re: Non-resident divorce proceedings?

The two of you can enter into a property settlement agreement dividing property and resolving other issues and permitting you to live separate lives. Then in August 2007 a complaint for divorce can be filed in

New Jersey.

Call me if you like.

Also, if there is adultery involved you can immediately file for divorce without waiting for one year.
