Need To Obtain Money From Spouse for Divorce

I have been married for 18 yrs and need to obtain a lawyer for representation for a divorce. My husband has been verbally and mentally abusive to myself and our children thru out the marriage and has always controlled all the finances. The problem is I do not have any money to retain an attorney. All money is in bank accounts in my husbands name. We recently took out a line of credit for $25,000 which he has and used to retain an attorney for himself. I am currently not working and have no money at all. I am of the understanding that I am entitled to a portion of this money but how do I obtain it without an attorney or find an attorney who will obtain the money for me so i can pay them for their services and have money to pay my bills etc.

We routinely face this problem and if we cannot get consent from the controlling party and his cousel to give you a like amount we ask the Court to order the relief.

It would appear that he has already taken a large amount so he would have to give you the same or at least give up half of what he took since it belongs to you.

You are entitled to file a motion requresting that the Court compel your husband to provide the money you need for attorney. To hire me you need to give me $165.00 to file an answer to the divorce complaint and to pay the fee for filing a motion and I will make the necessary application.

You find a tough, smart divorce attorney who will fight for you. The attorney will prepare papers asking the Court to force him to pay over enough money to allow you to get an attorney, and you take it from there.

You will need at least some small amount of money to get your lawyer started. This happens all the time.
