Obtaining Sole Legal Custody
My ex-husband and I seperated when my son was 3 months old. He is now 2. Visitation has been a continuing problem from day 1 in that my son usually comes home exhausted and not fed properly. There is absolutely no structure. One of my ex-husband's visitation days is during the week. Instead of spending quality time together, they spend the day driving from job site to job site - my ex is in the home improvements business. The last 2 weeks, my son does not not want to go with his father. I have bent over backwards with my ex to ensure that he and my son have a positive relationship, but I don't want to do that at the cost of my son's well being. Do I have a strong enough case to at least remove the mid-week visitation? What is a typical visitation schedule (we live 65 miles apart)?

There is no way any attorney can tell you if you have a strong case without have a lot more details. In addition, there is not typical anything when it comes to family law. That depends on many, many factors. I suggest you pick up the phone and speak to an attorney in person.

I would think that the Court would lean towards reducing visitation.
