Options in Family Court
I have joint custody of my son with me ex (never married). My ex has had physical custody since I was asked to leave the home a couple of years ago and a judge granted us joint custody last year. My ex is now seeking child support and I recently provided his attorney with my paystubs as he requested. According to my paystubs I made $600 bi-weekly (not a whole lot in this area with no support) and is now wanting to seek 1/4 of that a month in child support. Yesterday I received a letter that was sent to the courts seeking this support under a 5-day rule. What does that mean? I am not in a financial situation to pay my ex child support, esp since he makes a lot more money than I do, and am currently still in school and trying to establish my career. I have no family here and am struggling. I feel that my gesture in trying to keep my son close to his father instead of taking him back home after our seperation is now coming back to haunt me. He has made it very difficult for me to work certain hours, go to school and I no longer know what to do. He refuses to be flexible with me on visitation changes and in order to survive I've had to seek odd jobs at odd hours to stay afloat. What can I do? He wants me to sign over my rights or pay.

Order are served under the five day rule, under which the order is signed by the judge if the opposing party fails to file an objection to the order with the court. Non-lawyers like to call orders and other court papers "letters"
