Legal Question in Family Law in New Jersey
I was ordered to pay alimony based on a salary I had over two years ago, because when I was divorced I was unemployed. I have tried to have the amount changed, but have had no luck with a motion. I owe so much money because my current salary in today's market is less than half the salary used to calculate alimony and CS. I can't afford an attorney, how else can I fight this. Will I end up in jail if I can't catch up?

You said you filed a Motion and had no luck. Unfortunately, that is what often happens when you go into Court without an attorney. Experienced lawyers who practice in the area of Family Law are better equipped to put your position together than you are. Of course there can be no guarantees. I am just saying that you would have been (and still can be) in a better position if you go into Court with an attorney than without one. And to answer your last question, if a Judge believes you have the ability to pay and you do not pay, then you may end up in jail. Most judges use that as a last resort. However, I have seen it happen.
Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You will only be able to rely on advice from an attorney who you have actually retained. Good luck! Rob Gleaner
