Legal Question in Family Law in New Jersey

I am owed over 40,000 in child support. Is there another court that I can sue my ex in besides family court? For example criminal or civil court? The father lives in a different state. The order is here in my state. Can I file a motion in criminal or civil court in my state or his? If I did it in his would I get a better result or have better chances of getting the order enforced? Probation does NOTHING her in NJ and FL has just given him his drivers licences back that they revoked for non payment of child support. They didn't even make him pay any child support to get his license back. He went into court saying he was too sick to work and needed his license to go to the doctors. Of course NJ doesn't know what is going on with the case.

You can file a motion to enter a judgment in the amount of the child support arrears and then send the judgment to a lawyer in the state where your husband lives for collection. By the way, once you have your judgment, you can levy in New Jersey against funds held in a large, interstate bank or wages paid to your husband by an interstate corporation, doing business in New Jersey.

Actually, you will get a better and faster result in the family court. I am not sure why you think another division would be better or faster. A motion can reduce the amount to Judgement and then you can go after him with that Judgment.

Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. Further, no one can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have not already done so, you should immediately meet with a Family Law attorney for a full consultation before you take any further steps. You may feel free to call me to discuss this matter in more detail. If you do so, mention Law Guru and your first one hour of time will be free. Good luck! Rob Gleaner
