Legal Question in Family Law in New Jersey
According to my parents divorce agreement my father was supposed to set up a life insurance policy for my brother and myself as beneficiaries should he die. He passed away a month ago, and I have come to find out he never set up any such policies. Do my mother or my brother & myself have any grounds to sue his estate?

Hi. The answer to your questions depends on whether or not your dad would have the support obligation if he were alive. If so, I urge you to seek further information and representation. Best of luck to you whatever you decide.

It is all a matter of the agreement of the property settlement agreement which you parents signed and your age when you father died. I would expect that the requirement of life insurance was to protect the support obligation should your father before your emancipation.
