Legal Question in Family Law in New Jersey

According to my parents divorce agreement my father was supposed to set up a life insurance policy for my brother and myself as beneficiaries should he die. He passed away a month ago, and I have come to find out he never set up any such policies. Do my mother or my brother & myself have any grounds to sue his estate?
