Legal Question in Family Law in New Jersey

My partner and I have lived together in the same joint owned house for over ten years. We have two children but have never gotten married. We act and live like a married family and we now want to separate. Does NJ have common law marriage? Should we use the same procedure as a married couple and file for divorce?

New Jersey has no common law marriage. Based on what you have said, you are NOT married.
