Past due support and other questions?
In need for urgent answer to this question. Wife took temporary restraining order (now indefinite). Husband couldn't appear as he was overseas due to no US visa now. Wife also has temporary US visa. Marriage was done overseas 7 years ago and we have a baby (US citizen).
One, if husband, who may not be earning abroad, enters US later for visit or job, does he HAVE to pay the past due support required by the order or can he demand a hearing first?
In case he claims to have no money, can I ask the court to transfer the house title to me to pay for the support, without divorce?
Two, can I tell court he violated order by writing emails to me, most of them in reply to my emails though. Also after I took the TRO, I wrote many times to him to return home in NJ and he replied asking me
to return to home country basically. Is my request to him to return home taken as contrary to TRO where I claimed fear from him?
I hope I can get some answers before meeting a lawyer.
