Paternity Testing

My ex- is taking me to court for a paternity for my eight year old daughter in which he knows that she may not be his. He knew all along. Throughout the years he has paid childsupport and claim her on his income tax. He signed the birth certificate and raised her as his own without a problem. Recently I got married and he stop all contact with her and is now threatening me with paternity test and to sue for the child support he has paid. What are the legalities concerning this matter? Please respond

hi - you should definitely hire an attorney. matters such as this one are very complicated to litigate. he may be estopped from saying that he is not the father, since he has held himself out to be the father all this time.

In my opinion, after this long passage of time, a Judge would not allow your ex to take the position that he is not the parent, no matter what the paternity test shows. The reasoning would be that it would not be in the best interest of the child to do otherwise. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained.
