Legal Question in Family Law in New Jersey

I currently pay child support. My daughter is became pregnant at 16. My question is if a minor has a child are they emancipated? Do I still need to pay child support for her? She is not in schoolm she has her GED. SHe is taking on line college courses. Does this qualify as continuing the education and do I still need to pay support?

Pregnancy and/or child birth does not constitute a basis for emancipation in the State of New Jersey. You will need to continue paying child support for your daughter. Now, if she gets married, then that would be an emancipation event.

While pregnancy and/or child birth does not necessarily constitute an automatic basis for emancipation, under the right factual scenario, I can see that this may be one of the factors to be considered. If your daughter has graduated from high school and is not enrolled in full time college, this would be an emancipation circumstance, whether or not she has a child. Careful analysis of all factors is necessary at this point with an experienced New Jersey family attorney.
