Legal Question in Family Law in New Jersey
I pay child support for my 18 year old son. My current wife & I have an 8 year old son. My wife is pregnant and is considered high risk and has been put on bed rest by her doctor for the next 8 months. She applied for disability but does not qualify because she is an independent contractor. She made about $17,000 last year. Do I qualify for a temporary reduction in child support due to temporary hard ship since I am the only financial supporter for my son for the next 8 months?
1 Answer from Attorneys
Reductions in child support are based on the particular facts and circumstances. You would need to discuss this with an attorney in order to make a determination as to whether or not your situation is temporary enough or otherwise appropriate to give you a reduction.
Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. Further, no one can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have not already done so, you should immediately meet with a Family Law attorney for a full consultation before you take any further steps. You may feel free to call me to discuss this matter in more detail. If you do so, mention Law Guru and your first one hour of time will be free. Good luck!
