Legal Question in Family Law in New Jersey

I have been paying more in child support than I supposed to. currently the case is in appeals and we should be hearing something shortly. If the ruling is overturned and my ex owes me money back can I go after her tax return in the spring? I also just recently had a child with my girlfriend how is child support determined now with this change is circumstance?

You may get a credit, but the child's need for support remains. A balance will be struck between the two considerations. The birth of a child by another mother requires that the child support be recalculated by inserting your new support obligation into the guidelines computer program computation. The recalculation should cause a reduction in your obligation to the older child.
