Legal Question in Family Law in New Jersey

When does payment obligation cease

Children grown. Finished last semester of collage.

age is 22yrs. Now I here planning to continue on with

post graduate internship in field selected. Plans on

living in marital home with mother. Home is no longer

my obligation. Was bought out when youngest turned 18 yrs.

When is enough.

What do I need to do to finalize my obligation to the courts. I will continue to support my children as I

see fit but would like to do it on my own behalf and not through the courts. And I feel I shoul no longer

need to support my divorced spouse after 23 years.

Re: Emancipation of child

Absent written acknowledgement by your ex-spouse, you would need to file an application to the Court, indicating the circumstances that establish to you that the last child is emancipated. If the Court agrees, an Order of Emancipation will be signed and your payment obligation will cease. However, you or an attorney on your behalf, needs to file the application. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob Gleaner
